Justice Tajudeen Okunsokan of the Ogun State High Court has nullified a court judgment that had allocated approximately 4,500 hectares of land belonging to 14 Sagamu communities to the Oso-Edu family.
The affected communities, including Okerala, Igbo Iwaju, Torogun, Simawa, Ajebo, Ewu Ogundipe, Ewu Ololo, Alahun, Apena Seriki, Erungben, among others, were at the center of this land dispute.
Oniraniken of Iraniken, Oba Adewale Adeniji and some members of the Oso-Edu family, had earlier obtained control of this vast land based on a court judgment delivered by Justice AA Babawale on April 18, 2018.
However, in June 2020, Fasasi Tiamiyu, Olalekan Sulaimon and Saula Oseni, filed an application with the Sagamu High Court, seeking various remedies, including the annulment of the execution of the April 18, 2018 judgment.
Tiamiyu and his co-applicants, upon reviewing the certified true copies of the judgment, asserted that they were not involved in the lawsuit that resulted in the judgment and the subsequent land takeover.
The applicants further argued that the claimants, led by the traditional ruler, were not recognized by the communities that owned the land, portraying them as mere land grabbers.
Justice Okunsokan, in his verdict last September 22, annulled the execution of the April 18, 2018 judgment emphasizing that since the application’s facts established that the applicants were not party to the original lawsuit that led to the judgment regarding this land, the judgment should not apply to them.
