An Ijebu Ode High Court has dismissed an exparte application filed by the suspended chairman of the Ogun East Local Government, Honorable Wale Adedayo to stop his investigation by the council’s legislative council.

In the exparte application, Adedayo is seeking an interim order to stop the legislative council which suspended him, from acting on the letter of invitation sent to him, to appear before it on September 14, over the management of the council’s fund.

Alternatively, the suspended chairman wants the court to reinstate him as the council chairman.

Ruling on the exparte motion, Justice A. Omoniyi, faulted the suspended chairman for not filing the motion before September 11.

Justice Omoniyi ruled that he ought to have approach the court, since the legislative council issued him with the notice on August 31.

According to the Judge, the delay nullified his prayers in the application.

“Delay defeats equity,” the judge said.

He ordered the suspended chairman to placed the legislative council on notice and return for hearing into his originating summons on September 22, 202.
