Court Orders Delisting Of Otegbeye As ADC Governorship Candidate

A Federal High Court has ordered the Independent National Electoral Commission (INEC) to remove the name of the governorship candidate of the ADC, Barrister Biyi Otegbeye, from its list of candidates for the 2023 polls.

The Federal High Court sitting in Abeokuta on Thursday, ruled that INEC did not monitor the substitution of the ADC governorship candidate primaries, which produced Otegbeye as the party’s candidate.

The court also ruled that ADC failed to notify INEC of the primaries before the election of Otegbeye as its candidate.

Justice Akintoye Aluko issued the directive while ruling on an application filed by the APC against the listing of Otegbeye as the governorship candidate of INEC.

The judge berates the ADC for violating the provisions of the Electoral Act 2022, reminding political parties that Nigerians do not want elected leaders who are not law abiding.

He overruled the ADC objection to APC in filing the suit, since it is not an aspirant in the ADC primaries, saying that the APC filed the application against the action of the APC and not against the ADC.

Justice Aluko also overruled the argument of the ADC that the APC filed its application outside the time allowed by the constitution to file per-election matters.
