Supreme Court Dismisses Ihedioha’s Suit to Be Declared Winner of the Imo State 2019 Poll

Supreme Court has dismissed a suit filed by the People’s Democratic Party (PDP) governorship candidate in the 2019 poll, Emeka Ihedioha, seeking to be declared a validly elected Imo State Governor.

Ihedioha wants the Apex Court to sack Governor Hope Uzodinma as the winner of the 2019 governorship poll, on the ground he was not qualified to contest in the poll.

He argued that Uche Nwosu and not Uzodinma was the right candidate for the All Progressive Congress (APC) for the 2019 Governorship Poll.

Ihedioha contends that it was wrong to declare Uzodinma the winner because according to him, the APC had no candidate in the 2019 Imo Governorship Poll.

Justice Tijanni Abubakar, reading the apex court; panel’s judgement on Tuesday described ihedioha’s suit as vexatious and needless.

The apex court awarded a cost of N40 million against Ihedioha’s counsel, Mike Ozekhome, for bringing the matter before the Supreme Court.

The applicants in an affidavit they filed in support of the motion and deposed to by one Adedamola Falokun, averred that “The third Respondent/Applicant (PDP) is neither in any way seeking a review of the valid, subsisting and well-considered judgment of this court delivered in this appeal in 2019, nor seeking a review of the judgment of this court delivered on January 14, 2020, in SC/462/2019, but humbly seeking that this court give effect to its judgment delivered on December 20, 2019.

“That this court has the constitutional, inherent powers and jurisdiction to grant the reliefs sought and give effects to its judgment. That it is in the interest of justice for this court to exercise its wide discretionary powers in favor of granting this application as prayed.”

They argued further that Uzodimma was not the candidate of the APC based on the court’s judgment that Nwosu was nominated by both the APC and the AA.
