The senate has rejected the ruling of a Federal High Court, Abuja, stopping it from considering President Buhari’s request for the deletion of a clause from the electoral act 2022.

The senate president, Ahmed Lawan during the senate’s plenary on Tuesday, said the judiciary could not stop the national assembly from performing its constitutional functions.

Justice Inyang Ekwo, ruling on an application filed by the PDP on Monday, barred Buhari, the National Assembly and the Independent National Electoral Commission from tampering with the new electoral act.

Buhari had requested the national assembly to delete from the electoral act that he assented to last month, a clause banning political appointees from the congresses and national convention of political parties.

According to the judge, the electoral act 2022 is already a valid law, and that the proper place to challenge any provision of the new act are law courts .

The senate president faulted the judge, saying the national assembly has the constitutional powers to consider any request forwarded to it by the president.

Already, Lawan said the senate is following due process through the first reading of the bill.
