Court Refuses to Sack Ben Ayade for Defecting

Federal high court, sitting in Abuja, had refused an application seeking the sack of Governor Ben Ayade and his deputy, Professor Ivara Esu for defecting from the PDP to APC.

The PDP in its application, had requested the court to remove the governor and his deputy for transferring its votes in the 2019 poll to the APC but the counsel to Governor Ben Ayade, Mike Ozekhome argued that the issue in dispute had been settled by the Supreme Court in the Atiku case, asking the court to reject the application

Justice Taiwo Taiwo agreed with the submission, and ruled that there is no provision in the Nigerian constitution for the removal of governor, his deputy, as well as president and vice president for defecting to other parties.

Earlier, the court had ordered 20 members of the cross river state house of assembly who defected from the PDP to APC to vacate their seats.
