A federal high court, sitting in Abuja, has dismissed an application filed by the People’s Democratic Party (PDP) seeking the disqualification of All Progressive Congress (APC)’s presidential candidate, Asiwaju Bola Tinubu and his running mate Senator Kashim Shettima from the 2023 pols.

The People’s Democratic Party (PDP) in its application wants the court to order the cancellation of their candidacy and their names removed from the 2023 presidential candidates’ list.

The ground of PDP was that, the nomination of Tinubu and Shetimma was in violation of the provisions of the electoral act 2021.

In his judgement Justice Inyang Ekwo said, the application was an abuse of court process because the PDP is not a member of APC.

According to the judge, the issue in contention was an internal affair of the All Progressive Congress (APC) and that, The People’s Democratic Party (PDP) lacks the locus standi to file application to challenge the process of election of Tinubu as the All Progressive Congress (APC) presidential candidate.

“It is express in the provision of Section 29 (5) of the Electoral Act, 2022 that the right of action on the matter for which the applicant/respondent (PDP) has filed this action is given to ‘any aspirant who participated in the primaries of his political party’,” he said.

The judge said that it had been established that the PDP was not an aspirant of the APC.

“Therefore, there is no iota of law which support this action. It is on this ground that I find that this case is an abuse of process and I so hold,” he said.

Justice Ekwo, consequently, dismissed the suit for constituting an abuse of court process.
