A federal high court in Abuja, has rejected an application filed by the Central Bank of Nigeria’s governor, Godwin Emefiele, against the Independent National Electoral Commission (INEC) and the Attorney General of the Federation (AGF).
The apex bank’s governor, in an exparte motion, asked the court to stop both the INEC and the AGF from forcing him to resign his appointment 30 days to the 2023 presidential poll if he would want to contest in it.
According to Godwin Emefiele, in the application argued by a senior advocate, Mike Ozekhome in court, the sub-section 12 of section 84 of the Electoral Act does not apply to him because he is a public servant and not a political office holder.

He asked the court to invoke section 318 of the Nigerian constitution to stop those asking him to vacate office 30 days to the presidential poll if he wants to contest in it.
In his brief judgement, Justice Ahmed Mohammed rejected the application, ordered the CBN governor to notify the INEC and the AGF and serve them with the process of the court.
The judge ordered INEC and the AGF to appear before her on May 12 to explain why she should not grant the request of Emefiele.
Some groups have already purchased 100 million naira APC forms for Emefiele to join the presidential race, but says he is still awaiting God’s directive.
